Under Arizona law, ARS 4-244(33), "It is illegal: ... For a person under the age of twenty-one years to drive or be in physical control of a motor vehicle while there is any spirituous liquor in the person's body."
Thank you for your response. Can you let me know what to expect when we go to court? Should I retain an attorney for my daughter? She has never been in any type of trouble before and is quite upset by the whole incident. I am just wondering if it is a serious enough offense to hire an attorney or her pleading guilty what type of fine or if any jail time would even occur?. Thanks.

After the consultation, you can decide if you want to take the further step of hiring the lawyer to represent your daughter in court.
