    Default Georgia Credit Card Debt, Wage Garnishment and Bankruptcy

    Hello. I am writing for my husband. We live in GA. Up until last month for the passed 10 years he has been self employed. He was out of work due to an injury and ran up about 50K in credit card debt. All of our bank accounts are seperate. The only one he has in his name is actually in the name of his business. It is not a personal account. The house and the vehicles are in my name only. All the debt is only in his name only. We had not been worried about garnishment b/c he was self employed however last month he got a steady job, today we got a summons to reply to debt within 30 days. It was not an order to appear in court. We have been to an attorney to see about filing a Ch 7, but do not have the $1500 upfront they are asking for to file for us. I was reading the wage garnishment laws and it discusses "disposable" income I dont know what that refers too as we only have enough money each month to pay the utilities and child care. Please help.

    "We got a summons" - you are sued also? This is over a joint debt? If not, what were you told about your responsibility for the debt?

    That should say "he" got a summons. The b.r. attorney told me I was not responsible.

    If they get a garnishment order based upon a judgment against him, it would be against his income. If he's depositing his income into a joint account, or into an account that is in your name, the creditor will likely attempt to garnish the money from that account.

    is filing ch 7 the only way to stop the garnishment?

    There isn't even a garnishment order in effect yet, is there?

    no not yet, i am just trying to be proactive figuring out how to stop it, as we dont really have the money for the ch 7

    also the paper work served by the sheriff just states that we have 30 days to respond before they take us to court

    The paperwork probably says that if he doesn't respond within 30 days he may be defaulted.
