I live in California. My car was repo'd on Thurs I called bank/GMAC on Thurs & they basically wouldnt tell me anything because they have to go thru the "process" but said I could call back the following day. I called back on Fri trying to get the amt we owed & again they gave me a ball park figure but I didn't get the EXACT amt till Mon. Monday morning I sent them their money via "money gram" as they requested got the release from the police dept & had it faxed (per their request). This was all done by noon. Since Monday I've been waiting for them to get back to me to let me know when I can get my car back.
I called today (Tuesday) & they told me they still needed to verify my insurance & registration. My insurance is current and has been current and the registration was paid for back in March.
I'm puzzled because the loan is in my husbands name & he never got a phone call at work re: the delinquencies & although we were late...I did not realize we were 3 months behind. Since last year I have made numerous attempts to get the due date moved up to the 20th to avoid all the late fees however until the late fees were paid they would not do this. Last year I would throw in an extra 100 or 200 to try to chop some of the late fees down but they would just apply it to my next pmt because it was late based on the due date being the 10th. I finally gave up after numerous attempts because they would not apply anything extra to the fees they would just put it towards the next pmt. During this time I provided them with my cell #, wk # and husbands wk # in the event they needed to reach us because our home was in the midst of a major remodel so needless to say we should have been able to be contacted at one of these numbers re: the delinquencies. Since the loan is in my husbands name only I assume that is why they never called me but they also never called my husband regarding the delinquencies.
We did receive notice of the pmt being late and I can only blame myslef for not looking at them more carefully but after fighting with them so much last year I gave up and just knew I was always going to have to pay a chunk of late fees until a miracle happened to where I could make the pmt on the 5th as originally stated in our contract.
Now I know the bank just wants there money and I totally understand HOWEVER we've had the car for 4 yrs & it's a 5 yr loan (March 08 will be 5yrs) so who in their right mind would let their car go when there is so little time left on the loan. I'm sure this probably happens but again we never got any phone calls although I provided them with all the other contact #s possible. The collection dept also mentioned to me that they had no knowledge of my cell, wk# or my husbands wk #, how can this be? I'm still waiting on my bank records to verify the info GMAC provided re: my pmt history. They say I only made partial payment in March and missed a complete pmt in June & since the due date is on the 10th of each month when they didn't get the September pmt that made us 3 pmts behind so they took the car.
My belongings that were in the car are being kept in a undisclosed area in town which I have to pay storage fee of $122 + an addl $7 per day till the items are picked up.
I can't get the bank to give me a definate answer as to when they will sign off on my paperwk so I can get the car, is there anything I can do? I've acted upon this as fast as I possibly could but now they wont tell me anything & reading various comments thru out the internet I'm scared now because it appears that the repo yard can charge me storage fees IN ADDITION to what we've already paid. I'm at the banks mercy for them giving the word as to when my car will be released to me. I've spoken to the repo yard and they confirm they have the car HOWEVER they are closed on Thursdays so if the bank calls me tomorrow and says I can get it the repo yard requires an appt to pick up and same day is out of the question (per the repo yard). The repo yard is closed on Thursday can they rightfully charge me a storage fee when they are closed? This is out of my control. So really I think I may not be able to get my car till Friday and that is only if bank calls me by Wednesday and IF the repo yard has any avail appts, if they are booked then I have to wait till the following day which will be Monday and again IF they do charge storage fees can they charge me storage fees for appts they don't have avail and for days that they are closed which does include weekends?
I've paid the bank upon first notice of them telling me how much. I called them for the info they didn't call me. They got their money on Monday morning around 10:30 AM.
I realize we really messed up here if indeed my bank records do show that we missed pmts as stated however is there anything I can do to help myself now with all these costly fees...Did I also mention that the repo yard is almost 2 hrs away so I have to take time off work? HELP!!![]()
