    Default Filing Forms I-130 and I-485 on a B Visa

    Hi

    Two questions...



    Question 1.

    Regarding I-130 question 22

    If I was to file form I-130 and I-485 together while I lived in Phoenix … I would mail both to Chicago IL .

    But for this question should I put
    Chicago, IL ?
    or Phoenix, AZ ?
    or Laguna Niguel, CA ?




    Question 2.

    Regarding dates for I-485 and I-130

    In part one of the I-485… I was wondering about the following question:
    "Date of last Arrival"

    For example if my I-94 is issued April 2007, but I went to Mexico in August 2007 for two days, and didn’t get a new I-94 what date should I put on the 485 form if I am going to file it in September 2007?

    Also would the I-485 date be the same date that I would put on the I-130 for Question 14 “Date Arrived”

    That's pretty clear, isn't it? You put down the office where you wll be applying for lawful permanent residence. You don't put down a different office.

    For the I-485, use the information from your most recent I-94.

    sorry... but it isn't very clear.

    does applying mean the office we are submitting forms to... because that is a lock box in Chicago.

    Or does applying mean the office we are potential going for an interview to... because I hope that would be in Phoenix.

    ............

    also about the date... what happens if they scanned her visa after the date on the I-94 which is just a stamped date?

    It means the office where he will apply for permanent residence. Not where you send the form.

    There is an office in Phoenix Az, but the website doesn't provide if that office actually handles I-130 forms.


    The instructions for the I-130 form mentions for purposes of filing the form that USCIS Service Center having jurisdiction over Arizona is

    USCIS California Service CenterP.O. Box 10130 Laguna Niguel, CA 92607-0130"


    The concern that we have is in regards to the interview location. We do not want to put an office that is 6 hours away vs. one that is 30 minutes away. But we also do not want to put a location if the office does not handle the I-130 form ... We do not want to give the USCIS any reason to delay.


    So that is why I am being persistent on this question.
