    Default How long does marriage-based immigration take?

    I just had a quick question of how long everything takes. I'm planning on getting married to a US Citizen (I am Canadian) in the near future, nad I want to know how long all the different paperwork takes to clear.

    I know the K-1 validates me for entry for 3 months for the purposes of getting married, but how long does it take from filing that until I can enter the country? Is there any good reason to even bother with that K-1 and not just go in on a visitor's visa?

    Once we are married, how long does it take until I can begin working? I realize we have to file the adjustment of status forms, and if I understand correctly I also have to file for an SSN and EAD; so how long can I expect to be out of work after we get married?

    There are a bunch of "personal experience" type websites where people give their timelines for fiancee visas. You may want to search Google for them.

    The duration of the process may take several months, depends on the prcessing times of your regional Center. It will also matter how long the person will wait for an interview in Canada. This is a fairly quick process.

    You cannot come to the U.S. on a tourist visa with an intention to permanently stay here. However, you can com to get married, but must have an intention to leave. It is hard to prove such an intention... Any immigration inspector will suspect that you will stay here after the marriage.

    Before you do anything about your K-1, you should consult with a competent U.S. immigration attorney.

    I married a Canadian woman 10 years ago. Check the I-94 form for restrictions against: applying for an extension of the time in the USA, as well as applying for a change of status as the spouse of a US citizen. If you use an Immigration lawyer, be careful; I applied on my own for her documents (change of status, work permit, and advance parole), but the attorney we later went to made us file again, and mine came in before his did; I was just out a lot of money for nothing. The work permit is annual until the Green card is issued, as is the advance parole (make sure it is for multiple entries). It took about a year and a half back then for us to get the work permit. We had a 3 week visit allowed when she flew in from Winnipeg; we took care of that by going to Mexico for the weekend, and then when she came back, she was allowed in indefinitely until the change of status came in. Just be careful about it, in case they deny her entry (passport wasn't a requirement in 1998). Good luck, but before you try anything we did, check it out so you don't get stuck in Mexico or some other nearby island paridise.

    i just went thought this you need a k-3 visa that is a fiance visa it will let you come to us so you can get married then you will need to file I130 and after that is appoved you will need to file an I485 for adjustment status to become permanent resident just bing here with the K-3 visa you can file a I-765 application for empoyment authorization based on the visa and that will allow you to work in us untill everything goes through. the I130 takes about 6 months and the I485 takes about three months and the visa can take up to 6 mo if everything goes good and you have not had any issues with immigration in us before such as deportation or troubles with law ect...you can do all this on your own you do not need a lawyer i did it by myself and my husband now has green card

    I agree with babyfaceestrada. Besides you're a Canadian Citizen. You can enter the US coz of the treaty (just dont let them know your intention to marry or they will deny u entry). Just make sure u stay in the US until all paperworks are done. It was suggested to me to file all said application AT ONCE. and one person I know got her working permit within two months (she's even an illegal resident for almost six years). A USCIS agent told me to file it all at once as well. Just dont find working without the working permit. Stay as a tourist if u can afford to. U can get married in two days. and file paperworks. All in All.. it costs $1700. The agent even quoted to me the maximum total cost.
