    Default Renter's Rights Upon The Sale of Real Estate

    I am currently in the middle stages of a separation. My mother in law lives downstairs and we are looking to sell the house. My wife does not care what happens to her mother if the house is sold right away. Her mother has looked into senior housing places nearby but there is a waiting period of at least six months. She cannot afford to live anywhere else because of her limited income. Does she have any rights? She did pay rent until two years ago, when she retired. Could there be a waiting period to sell the house until she finds another residence? We live in NY State.

    As I see it, the options are: (a) You can delay your plans until she gets elder housing. (b) She can move voluntarily. (c) You can try to sell with her as a tenant. (d) You can evict her.
