    Default Problems During Hospitalization

    I will make this as short as possible.

    I have two questions...Here is my first question

    Do I have a case

    1) I was admitted into a hospital and received horrible care

    2) I was given one medication that I had been hospitalized in the past for taking ( they have that in their records)....also one medication I refused to take was also given to me

    3) After a different oncall dr came in to see me ...he cut down on some of my medications...so, I was awake ...but, very confused. I left the hospital against medical orders and told the doctor because I was afraid they were going to accidently over dose me and kill me. HE GOT MAD!

    4) I could not afford my medical records so I asked for an itemized bill of my hospital stay.....in aproximately 50 hours.....I was given 68 shots or pills..( most were shots)....some was for pain, some muscle relaxers, some for nausua, and some of the pills were just a mixture.

    5) I checked in with anxiety, depression, and panic attacks. Since I have checked out ( besides the obvious swelling, redness, whelps, etc. in the hospital)......my anxiety, depression and panic has gotten worse since I have been home. I am also having anger problems that I had not had in the past. I think I am so angry at the hospital and doctors because I think about it all the time that I am taking it out on the people I love the most...my family.

    Oh, I forgot to add...when I received the itemized bill of the medication I was given...I looked up on the computer...one had sever and most had moderate risk if given together.

    So, do you think I have a case?

    The other question I have-

    I live in MO and this happened in IL. Are there a way to look up attorneys on the internet for an attorney that practices law in both states?

    I appreciate any and all oppinions..thanks!

    A little confusing.

    First, did you receive the injections?

    Second, what is it exactly that you think is malpractice?

    You were voluntary admission to a mental health unit or free standing psych hospital?

    You refused meds and signed yourself out AMA with 50 hours. You are going to have a difficult time stating you are now having consequences from treatment which you refused.

    The charges for the meds can be matched with the nursing medication record. They gave them and you pay or they didn't give them and you don't pay. This is done through the billing department.

    Medications have the potential for all kinds of interactions, side-effects and complications. You either have something or you don't. It's not a matter of if.

    Yes, you can find someone on the internet. You are likely to find an atty who is licensed to practice in both states.

    No, I was admitted to a very well known hospital that has it's own floor for Migraine Patients. I was being treated for Migraines. I was told I would receive DHE IV treatments to break a migraine cycle. Well, after my first shot I was in Lala land and extremely sick when I would wake up.

    I did receive the injections.

    I told the admitting dr I did not want to take Depakote because I was afraid of it. ( I don't like medication...I have a fear of it for some reason..and not a greater fear)....It was in my report that almost two years ago I was hospialized for Neurontin..( it made me go into a deep dark whole of depression).....so, I did not want Neurontin because of my PAST problems with the drug Neurontin. They gave me Neurontin anyway...( some doctors I guess still perscribe this med for migraines).

    I hope that helps ...if not...I will try again...( I am horrible at writting..sorry)

    That's fine. It was a little vague but that helps.

    Do you agree these are the issues?
    1 You're being charged for meds that you don't believe you received.
    2 You received meds you refused and should not have received.
    3 You did not receive the medication for your symptoms that you thought you would receive.

    Thanks for being patient with me.

    I beleive

    1) I told the admitting dr I refused to take Depakote ( my own personal oppinion)....I think I have the right to refuse a medication...but, it was given to me anyway.

    2) I told the admitting dr that I had been hospitized for taking Neurontin almost 2 years before and I can not take that drug....( this was also in my paperwork)....the drug was given to me anyway.

    3) I beleive with the 68 shots and pills I was extremely overmedicated. I was so overmedicated at times I could not speak....I remember trying...but, I couldn't. Finially a different dr on call pulled some of the meds away...that is when I realized I had to get out of their or I would be overdosed.


    4) I beleive that checking in for Migraines and getting 68 pills and shots ( mostly shots) is too much for one person in 50 hours. I know it was for me.

    I was almost 10 hours from home and I remember asking for help I was really sick...swelling, whelps, redness, etc...but, then I would just fall back to sleep. My mother and my husband called the hospital and said I needed help and my husband just came and picked me up. ( When they would call me I guess I was not making any since.)

    I appreciate the help...stick with me and I will try to get all your questions answered. I really feel like I have a case...but, I would like someone else's oppinion also.

    If you received DHE IV treatments they had to give you at least 9 of them. And I think the protocol is for an IV anti-emetic. That would be 18 doses of meds (much fewer than what you say you were billed).

    I understand anticonvulsants are given prophylactic for migraines so I wonder why they were given during the course of your treatment.

    That's a lot of medication especially since what you are describing sounds like either an allergic reaction or drug interractions. If that is the case, you'll see what all the other meds were.

    If you are going to speak to an attorney about receiving Neurontin (I am encouragng you to do that) do not speak with the hospital about the charges for the medications or about your bill.

    You have the right to refuse medications.

    If you warned the hospital you were allergic to or previously had a reaction to a medication, and that drug was administered anyway you should contact an attorney.

    See what you can find out by looking for an attorney and let us know. I forgot to ask you how long ago were you released from the hospital?
