My husband is currently incarcerated in california. We are having an issue with transferring parole to a new county here is the situation:
My husband committed his offense in LA county. I currently live in san Bernardino county (both in California) I have lived in the same area for 4 years now, and it will be almost 6 by the time he gets out. He is going to be paroled in about 18 months.
He is a "high risk" parole, prison gang drop out, street gang drop out and a violent offender.
He is going to need to get his parole transferred to San Bernardino county. I have been told information from the parole department in my local area, and the county of committing offense and they have both told me different information about how long I have to live in the residence before he comes home in order for the parole departments to grant the transfer. The county I currently live in said that they will not have a problem with him transferring his parole here, as long as I show that I want him to live with me, and I am aware of him coming home to me. They told me that I have to show that I have lived in this vicinity for about a year. The county of committing offense told me that there is NO guarantee that they will grant the transfer. I told them that he is a gang drop out, and his family lives in this other county, where is he suppsoed to go. They told me that they would grant the parole transfer if he were to prove that he has family ties in the new county, and that I want him there, they said that I have to live in the SAME house for over 2 years.
Is there any reason why they would NOT allow him to transfer his parole to my address. He does not have an address to go home to in LA County, and I am his wife. When he is released, we will have been married for almost 6 years. We are well established in this area, our daughter has gone to the same school since kindergarten, when he comes home she will be in 3rd grade. I have worked in this area since we moved here.
Does anyone have any clue as to what can be done to guarantee a parole transfer to a new county, and what needs to be done in order for that to happen??
Thanks
