    Question Retroactive Utility Charges in California

    My lease states that we pay 1/2 of the water and garbage pickup. The property manager hasn't charged back the bill for over 2 1/2 years (I've lived here 3+ years) If they suddenly decide to enforce that clause, like if I move out, how far back can they legally go to charge me? I can't seem to find it in CA Civil Code..

    Technically speaking, they could try to enforce it as a matter of contract. For written contracts there is a four year statute of limitations. You could respond by trying to argue that the provision was waived, and point to past practice as evidence of the waiver.
