Our son joined the National Guard for tuition benefits. While he was in Iraq in 2004, the college informed him that the Guard had not paid his $1200 Spring 2001 tuition. He told the college it was not his debt and to get the money from the Guard. He didn't hear anything else until he got a letter in October 2006 again asking for payment - he refused again. Now, in 2007, the NY State Attorney General is going to sue him (it is a state college.) He hasn't been served a summons yet, but it's coming any day! He is determined that he is not going to pay this and is willing to go to court - he feels the State is cheating him out of a benefit he rightfully earned.
The question: Does the 6-year Statute of Limitations on debt apply if the plaintiff is NY State?
