    Default Landlord Trying To Charge $500 Over Deposit for Painting

    Hello, I have lived in a private condo rental for over 2 years. When we moved in the paint was ugly so we painted it a nice beige color. Now the landlord is trying to charge me for painting the room even though I believe California Law states that if you live in a residence for 2 years you dont have to pay for it. Do I have a case here?

    That's not law, although paint in apartments depreciates quickly.

    The issue here, though, appears to be that you painted the apartment without permission, which raises the issue not just of the age of the paint but also of restoring the apartment to its prior condition.

    Still, if you didn't cause any damage when you painted, and the cost of repainting is no higher than it otherwise would have been, the landlord can only charge you for the depreciated value of the paint. If the paint was fully depreciated by the time you moved out, again assuming no damages to be repaired from your repainting, then you should not be charged at all.

    Thanks Mr. Knowitall,

    The landlords were aware that we were painting, but were under the impression that we would repaint or pay to repaint when we moved out even though we signed nothing to this affect. My argument is that since we lived in the condo for 2 years that no matter if I painted every wall in the house, I shouldnt have to pay anything since they should have to repaint anyway. Am I correct?
