Hello Forum!
I am a renter in a house in Newport Beach, CA. In July of 2006 i signed into a lease with 3 other people (all signed at the same time). It is 4 people in a 3 bedroom home, 2 of the roommates share a room. another roommate and I have our own rooms. Our one-year lease ended on july 5th 2007 and the landlord currently has us in a month to month situation.
Here is the dilemma:
One of the 4 roommates has become a burden to the rest of us, and we all agree that we want her out. We don't even need to replace her, the other 3 of us are happy to just pay a little more. Even though we are clearly unhappy with her, she hasn't shown any signs of even thinking about leaving. We plan to all talk to her and see if she will leave with dignity, but what if she refuses? Is there anything we should do first before we talk to her? how can we stay ahead of the game. We have already talked to the landlord and he said he would prefer not to get involved and to try and handle it ourselves. Are there any standard procedures here?
I was thinking that since we are in between leases we could ask the landlord to write up a new lease without her in it, and give her adequate notice to move out. is this legal? is it a good idea? What does everyone think?
any advice would be greatly appreciated. we want her out ASAP, thanks!
