    Default Do Association Bylaws Supersede County Ordinances

    I am renting my former residence to my daughter, son, and three friends. The County's definition of a family is a maximum of five unrelated individuals. The homeowner's association is contemplating amending the bylaws to limit the number of tenant's allowed in the single family home. 1) Can the homeowner assoc. bylaws supercede the County ordinances? 2) Would a preexisting lease be grandfathered in? This is in Florida.

    The homeowner's association can impose more restrictions than local laws and regulations provide. There may be limits on what they can do, such as under fair housing or discrimination laws. To the extent that the lease is "grandfathered in", the grandfathering can be expected to end at the conclusion of the lease term.
