    Default H1-B Transfer Help

    Hi,

    I am working for Company A and I am planning to get my H1-B transferred to company B, a US based employer. I have few queries and it would be great if I could get them answered.

    1. In the worst case of any lay offs after joining Company B, what would be the state of my H1-B?

    2. How long can I remain in US and search for a different job?

    3. The company has offered to process my Greencard. I understand that obtaining the Greencard is a four stage process. Which stage of the Green card processing should I cross or be so that my company cannot lay me off? How long would it take to come to this stage?

    If you are laid off, you have a ten-day grace period to pack up and go home.

    Even with a motivated employer, you can expect it to take five or more years to get an employment-based Green Card.
