    Default Taking A Minor to Vegas To Get Married

    A dear friend of mine is in a movie like situation. (Dont try to write this, we're already drafting the script.) She's about to turn 15, she's in love he's over 18, her family has been homeless since june, and (sleeping in shelters, cheap hotels, and most recently their conversion van). All along her "love" has stuck by her side. In Nevada, if you are 16 you, "Must have consent of a parent or legal guardian. Minors will need an original or certified copy of the birth certificate which lists the name of the consenting parent" as stated on clark county web page. ...
    The young lady's father, is fine with the marriage, and has agree to either accompany the couple or get "an original, notarized statement in English must be presented with the certified copy of the birth certificate or a certified copy of the guardianship order at the time of the issuance of the marriage license".
    The mother on the other hand, has been declared mentally unfit to make decision's for her self due to muliple strokes and various unfortunatly illness's.
    The question here is, will this young man face any potential legal trouble by going to Vegas with this young lady to become married. If the father decides not to attend the nevada ceremony but does supply the needed notarized statement, can the young man face in legal charges for transporting a minor over state lines, or having honeymoon night relation's? Also, when the two get married, will there be a need to return to the ohio courts to seek emancipation, or is it automatic upon marriage? We are just trying to cover all the bases.

    She's about to turn 15? Are you seriously trying to tell me the father is okay with his 14 year old daughter being married?

    thank you. No, my apologies. She is 16 now. She turns 17 in May. They plan to marry this years end

    For a minor to marry in Vegas,
    Quote Quoting Minor applicants, ages 16 or 17 (not yet age 18):
    • Must have consent of a parent or legal guardian. Minors will need an original or certified copy of the birth certificate which lists the name of the consenting parent. (No photocopies of documents may be accepted.) Legal guardians are required to present a certified copy of the court ordered guardianship papers. (No photocopies may be accepted.) A parent or guardian is required to have acceptable identification to prove they are the parent on the birth certificate or the legal guardian on the guardianship order.

    • If it is not possible for the parent or guardian to be present, an original, notarized statement in English must be presented with the certified copy of the birth certificate or a certified copy of the guardianship order at the time of the issuance of the marriage license. The notarized statement should contain the parent or legal guardian's full name, relationship to the minor, minor's full name, birth date and the statement that the parent or legal guardian gives consent for the minor to marry. All documents must be in English or translated into English by a notary.

    • A person less than 16 years of age may marry only if either parent or legal guardian files an action, pays all court fees as provided by law, and presents a court order, from a Nevada State Court, authorizing the Clerk to issue the marriage license. Applicants should contact an attorney to prepare the documents. This office has no forms.

    The question's here are,
    1)In the state of Ohio, can this young man face any potential legal trouble by going to Vegas with this young lady to become married?

    I would think that since wedding would take place in NV that license would be sought there meaning parent would need to be in NV with minors

    We already know that the license needs to be from NV, and the parents presence are not needed if a notarized letter with the one of the parent's approval is supplied (although the father will most likely be present, because he supports this.). That's not the problem. THe problem is, or what concern's me is, an article that I read online about a man that received the parents permission to marry his fiance and they travelled to kansas I believe. Upon returning to Nebraska he was charged and convicted of sexual assualt against a minor. Thus, I don't want this young man to travel to vegas (with or without her father, whom is okay with the situation) and once the newlywed's leave NV he is arrested back in ohio. I also am concerned about whether or not emancipation is a legal process that needs to happen or if it is automatic upon marriage. ...

    If you're worried about violating the law and facing charges for state or federal sex crimes, consult a lawyer. Nothing you read here will protect you if you break the law.
