    Default Is Duress a Reason to Void a New Car Contract

    I live in the State of Maryland. on 8/31/07, I called a dealorship because I heard that they were advertising 0% financing. The sales manager tells me that I need to come into the dealorship in order for him to explain the details of the deal.

    I state that I don't have transportation at the moment, but can come in later. He then sends a salesman to come pick me up. The sales person states that I will be buying a car from him today.

    When I arrive at the dealorship, I reject the initial offer b/c the price is too high, its the wrong color and doesn't have the options that I want. I ask the sales man to tak e me back home, he says no, that I will have to take the shuttle. He then gets the sales manager, they both state that they might can come up with another offer if I wait. They disappear into the sales manager's office for nearly an offer. I wait because I don't have another ride home. During this time, I receive numerous telephone calls from other dealors.

    When, my phone rings, the salesman notices it from the general manager's office, he exits the manager's office and grabs my phone. He instructs the other dealer staff to keep me off of my phone. When I leave the dealer showroom, to use my phone in the parking lot, he follows me and intecrcedes in my telephone conversation.

    I constantly beg him to take me home b/c I am diabetic and am getting sick. Finally, the sales manager offers me the car at $2,000 under invoice in the color I want without the options that I want. I bought the car, but now regret it. What are my legal remedies? I am waiting on a call back from the Attorney General's Office of the State of Maryland.

    The duress was what? Your choice not to walk way, call a friend for a ride, get a cab, or take the shuttle?

    I did call multiple friends for rides, it was the middle of the day, none were available. The dealership was in an isolated area and the local taxi company did not service the area. The dealership says that the shuttle was not available. And where could I walk away too? The woods?

    If it was not duress, they used strong arm tactics. The dealership was Ourisman Honda of Laurel, MD
