I have lived with my roommate in an apt. in Los Angeles for 6 years. We are now on a month to month basis with our landlord. I gave my landlord 30 days notice that I will be moving out. I want to be taken off of the lease and I want my security deposit back. Is it my landlord's responsibility or my roommate's to return my deposit? I have heard conflicting information. My roommate will continue living in the apt. alone. I have spoken to both of them and neither wants to give me my deposit back. My roommate thinks it's the landlord's responsibility and my landlord doesn't want to return it until my roommate vacates the property, which could be 5 years from now. Also, I initially gave an additional $1,000 deposit for my dog, who is also leaving with me. I am afraid my landlord will not want to give me that back either. The carpets have a few stains on them, not necessarily from the dog, but it seems to fall under normal wear and tear, after all, we've lived there for 6 years. I would think she would replace them anyway.
