Transfer From OPT to H1-B

Hello
My OPT expired on 7/31/07 and my employer filed for H1-B visa on 4/1/07. The Company lawyer told me I can stay during the gap between my opt expiration and H1-B starting date (60 day grace period).USCIS requested RFE on august 10th and the lawyer will send the RFE responed on 9/10/07 with an upgrade of my case to premium process. What is my chances to know if my case will be approved or denied before
oct 1st 2007? And If I didn't get any reponse by oct 1st do I have to leave USA before oct 1st. Please advise.

As you note, you have a 60-day grace period following the end of F1 OPT during which you can remain in the United States, although you cannot work during the grace period period. Your lawyer is probably anticipating that the H1B will be granted before your grace period expires. You should, of course, discuss your concerns with your lawyer.
