    Exclamation Cops Have Been Called

    I'm 25 i moved into a house with a minor when i was 24 and she was 15 she is now 16. I really care about this girl more than anyone else in the world we became really close. we decided to start dating i have a prior record lewd and lascivious acts on a minor i served my time completed probation and got a 1203.4 and the court dismissed the charges i don't have to register as a sex offender. Nothing sexual ever happened between us, It was never an option we never even discussed it. there were times where the emotional abuse was so bad she would come into my room and wake me up to talk to me. Since she has never had anyone to talk to she writes down everything in note books, she has also been documenting the abuse in her note books. i didn't want to leave but i had to they started accusing me of sleeping with her. it was too much for me to deal with. i just found out that they had called the cops. I've been gone for a month i saw her once because she called me and told me they were hitting her. the cops said this is a low priority case and they will get to it when they can. I've kissed her twice on the cheek which is in the note book and i will admit that because it wasn't sexual at all she came to me crying saying she couldn't take it anymore and she didn't know what to do. i was trying to comfort her. I need to know what i'm up against. the parents have threatened her and me with truth serum, among other crazy things. which i said i would gladly take along with any other test. what could the charges be? Since we didn't have sex can they charge me with it? and how will my prior effect this? also i'm in california. and i can't afford an attorney so will a public defender do in a case like this?

    First you need to know that even though you had an expungement for the previous offense, that does not stop a prosecuter from using it in a subsequent trial. And the bar for conviction in the eyes of a jury is now lower. You could be charged with a crime even though it did not happen, but getting a conviction would be another point. You did the right thing by moving out and as long as you are telling the truth about no sex, no fondleing, no nudity in her presence, no anything even remotely sexual in nature, you will be fine. As for the abuse she is being a victim of, you can notify the Child protective service of the welfare division and let them do the investigation. Otherwise please stay out of this situation for your own good.

    Prior acts may be admissible to demonstrate motive, opportunity, intent, preparation, plan, knowledge, identity, or absence of mistake or accident. In any particular case, it will depend upon the full context of the prior act, the state's rules of evidence, and case law.
