    Question Battery Charge After Tossing A Coin At Somebody

    I tossed a coin at a man, trying to get his attention (he had been using his cell phone for 1.5 hrs in the movie theater), and he had me arrested for battery. I admitted to the cop that I threw the coin. I had no intent to harm the man, and I do not believe the coin even hit him, but he claims it him in the head. Trial is tomorrow. Will this be my word against his? The man who had me arrested also says he is a corrections officer, but if he was he was not on duty or wearing a uniform of any kind, if that has any impact. I know throwing the coin probably wasnt the best idea, but I was trying to disrupt as few people as possible to stop this man from aggrivating myself and everyone else behind him in the theater. In hindsight I should have just bothered more people by making them all stand up while I walk out to talk to the mangager; my mistake. I attempted to appologize but the man was on an ego-trip and wouldnt hear a world I said. Would my best bet me to plead not-guilty and just speak my side? Any other advice?

    Your best bet would be to get help from a criminal defense lawyer.

    At this first trial where I am to plead guilty, not guilty, or need time to speak to attorney, am I allowed to bring a witness who can say that the coin did not hit the man? Thats 2 against 1. Does that help me much?

    Hit the chair and made a noise.


    If it hit him or not I cant be sure. Its a movie theater, so naturally its dark. Still, hitting him was not my intent. I only wanted to get his attention so I could motion him to lower his phone.

    When you show up for court, you will get to stand in front of the judge and he will ask you how you plead. The last time I was in an Indiana court, the judge asked each defendant would they like to plead guilty, not guilty, or do they wish to speak to an attorney before they enter a plea.

    No witnesses were allowed at this point.

    then they took everybody, no matter how they plead, and marched them down to the jail and locked them up.


    just kidding.

    Another question. If the judge is going to dismiss the case, when will he do that? Is it before or after the plead (or request to speak to attorney)?

    If I plead not guilty, would it be likely that its dismissed becuase its word against word? I forgot to mention before, I have never been arrested or even had a speeding ticket.

    Also, if a case is dismissed, is that the same as the charges being dropped? If so, then I should be able to request this be expongened.

    Go for a jury trial. Try and get as many moviegoers on the jury as possible. You may get an award along with your acquittal.

    Was that serious asking for a jury trial? Does anyone know about how dismissing works?

    I am not sure why my topic has changed, but this is for battery charges, not assault. Sorry for the confusion.
