    Default Foster Parenting

    In April of this year I had a 16 year dumped in my driveway by his biologicial mother. This kid is on probation x2 felonies. He is an outstanding, respectful and willing kid. Since April we have appeared at least 6 times in court for him and won temporary custody from his mother.

    His mother put him into the system for taking her vehicle. He served 6 months hard time and when he came out instead of transfering his school records, she re-enrolled him as a Freshman. After several months we have won petitions to re-instate his credits.... Yah a Junior now. This was to keep him in school as long as possible, Dad pays a lot of child support and it continues till he is 21 if in school.

    Here is the problem, the Probation Officer is siding with mother (Even though we have 20+ years in Law Enforcement). He wasn't scheduled to get off probation till October after his 17th birthday and all of a sudden the Probation Officer wants to let him off early, two days before his 17th birthday. Keep in mind this is a woman who locked him up for crossing 20 miles into the next county to pick up horse feed for his horse, he was with an adult but she didn't care, she pulled him off a School Bus in full Football Gear and locked him up.

    The court that gave us custody of him is the probation court and that judges jurisdiction on covers him while on probation. Where should we go from here. I know in Texas at 17 he can walk out the door and there is nothing his mother can do about it but I really don't want her on my doorstep.

    Please help me save this kid.....

    That's not correct. Typically, yes, the authorities will be hesitant to force a 17 year old home. However, as this kid is already in the system, they will be much more vigilant about his where abouts and doings.

    I'm a bit confused, though. What felonies? Going 20 miles over county line is not a felony.

    Taking his mother's car one time without permission is not usually prosecuted in this manner.

    Couple of things in Texas 17 is considered an adult. I work for a police agency and no we can not force a 17 year old to go home. We can only tell his parents they are fine and where they are.

    Second, his uncle took the vehicle without permission and my foster son drove it home to his mother house but had an accident. This is an Unauthorized Use of a Motor Vehicle which in Texas is a felony. Then he did it again so it was considered 2 charges.

    I spoken with the officer that filed the charges and he said that the mother craves negative attention from Law Enforcement and not all there.

    The age of majority is 18 in Texas. What happens at age 17 is that a minor ages out of the Texas juvenile court system, so the police can do little about a minor who runs away from home (and, it seems, often just choose to stay out of it).

    Hmm, tell that to the Dallas Police Department. You most certainly CAN force them home, especially once a parent gets a court order forcing you to do so. It's has been done. As a matter of fact, I was just talking to a DPD cop about this very subject. The 17 year old can (and will be, at least by her) detained until it is determined exactly where the runaway minor is going to go. As I stated, as he already has had legal issues, he is still under the supervision of the TX Juv. System.
    TX Juvenile Justice Code:
    (2) "Child" means a person who is:
    (A) ten years of age or older and under 17 years
    of age; or
    B) seventeen years of age or older and under 18
    years of age who is alleged or found to have engaged in delinquent
    conduct or conduct indicating a need for supervision as a result of
    acts committed before becoming 17 years of age.
    17 is NOT a legal adult in TX. 18 is the age of majority.

    That is the original point in my first request. He will be released from probation on September 20th. There fore he will no longier be under the court supervision.

    My question is which court will be turn to now.
