    Default Family and Medical Leave

    I have been employed with an airline as a flight attendant for six months. I'm having surgery at the beginning of October 2007. I was informed by my manager that the company is not required by law to grant me medical leave and it is determined weather to grant leave on a case by case basis.
    Is there anything I can do to take leave without getting fired? My company is continually hiring flight attendants, so they can't say there is not a job for me when I come back after 6 weeks.
    I live in Salt Lake City, UT and my company is headquartered in St. George, UT.

    If you have only been with them for six months now you will not be eligible for FMLA by October. One of the criteria for eligibility, and ALL of the eligibility criteria must be met, is that you have worked for your employer for no less than 12 months.

    That being the case, unless you have a bona fide contract or CBA that specifically says otherwise, or there is a state law that grants you additional leave protection (Utah does not) your employer has no obligation to extend you any medical or family leave and if you take any, they are under no legal obligation to hold your job for you or offer you employment when you are able to return.

    I can't tell you whether they WILL fire you. What I can tell you is that legally, they CAN fire you.
