    Default Marriage After Overstaying Visa

    hello
    i came to the usa on a tourists visa, i met a man, and decidedto stay with him. i applied for the visa extension but it had been denied. since then ive been taking care of his two children, and our daughter that was borntwo years later. we couldnt get married because his divorce was still in progress when we met. besides that we didnt want to get married just because of the papers. we can and we want to get married now, but we dont know if we can just go and get married and then apply for papers, or do i have to go back to my country and get fiance visa. do i have to worry that i might not get that visa after being here illegally for few years? i havent worked here, didnt do anything wrong, i was just taking care of boyfriend, my stepchildren and my daughter, doing everything i can to make their lives better. i love them so much i cant leave and not know if i will ever see them again. i sacrified a lot from myself, so please dont judge me but help me take better care of the ones that i love

    Marriage, unfortunately, would not resolve your immigration problems. I suggest that you consult an immigration lawyer for specific advice about your situation.

    Thank you for your answer. I will keep looking and try to contact an immigration lawyer. Do you, or anybody, know not to expensive lawyers in Riverside, CA?

    Dear Agniezka,

    You CAN get Permanent Residence Card (GREEN CARD) if you get married to a US citizen, assuming you came here with a visa. Since you entered with a visa, if you get married, you will be able to adjust your status and get a Green Card.

    You should not leave the U.S. because you will be subject to a 10 year bar.

    Before you do anything about his immigration status, you should consult with a competent U.S. immigration attorney regarding your adjustment of status.
