    Default When Does The Statute of Limitations Start

    I incurred several business debts in 2001 in the state of NJ. In 2002 I ws sued for one of them and a judgement was placed on my credit however they never attempted to collect...until today (8/30/07). When does the SOL start? From date of last activity in 2001 OR when they won the judgement against me in 2002?

    Any help woud be appreciated.

    Judgments last for the length of time as prescribed by the law of your state. Usually this is ten years and some states allow it to be renewed. This is from the date the judgment was entered and has nothing to do with the SOL for the debts. The clerk of court can tell you.

    Thank you for your information however I am hoping to ascertain when does the SOL start? I understand the judgement staying on one's
    credit report for 10 years however I am wondering since the date of last activity was 6 years ago (1 yr PRIOR to the judegment) if I can now turn around and tell this collection agency that the SOL has run out and that they should not contact me again OR if a collection agency can attempt to collect once they have a judgment against me for the 10 year period?

    The statute of limitations on a judgment starts to run when the judgment is entered.

    I believe this is the correct citation in NJ. Enforcement of a domestic judgment must be commenced within 20 years. Since you are talking a year of possible difference, 2001 or 2002, arguably it will not make any difference legally, since it is far from the 20 yr limitation.


    Foreign judgments are another matter, 2nd sentence.


    2A:14-5. 20 years; judgments
    A judgment in any court of record in this state may be revived by proper proceedings or an action at law may be commenced thereon within 20 years next after the date thereof, but not thereafter. An action may be commenced on a judgment obtained in any other state or country within 20 years next after the date thereof or within the period in which a like action might be brought thereon in that state or country, whichever period is shorter, but not thereafter.
