    Default Creating an Online Pharmacy

    Hello my name is Shane Jackson and currently i operate an advertising company for online pharmacy programs. Anyway i wish to put together my own online pharmacy program and have affiliate marketers such as myself market the medications.

    We will offer non-controlled medications.

    The pharmacy that i want to partner with claims that they are able to ship nationwide because of a tribal license that mean they can ship as long as it allowed by federal law. So they say dispite the state laws (some don't like medications shipped to their state) that they do not have to obey them since they are federally regulated. Ok that is fine if it's true.

    What i want to know is what is the legality of this business really? Does anybody know.

    The company i advertise for seems reputable. They have a good software program in place that keeps people from placing multiple orders, They have licensed us physicians who review medical questionnairs that are submitted by each patient..prescriptions are given based soley on the answers on the medical questionnair, these meds are non-controlled meds. They have a US licensed pharmacy ship out the medications that are approved by the physicians.

    So i know that the medical questionnair is not the most popular way to approve a prescription but is it illegal to do it that way? I know for a controlled substance it is illegal. But what about non-controlled medications?

    Any real legal help would be compensated. I wish to begin my own online pharmacy based on this example. I have the software and the pharmacy to ship out the orders once approved by the physicians. Any advice on this subject??$$$$$$$$

    Thank you for your response, but i do believe as a company we have a way around that issue. Since our Dr's will recieve a tribe license then they should have federal jurisdiction. Would that not cover california and other states that operate in the same manner?

    I know that's how it works with the pharmacy that ships out our orders. I was made aware that any physician that reviews our patient requests can recieve the same type of license if the physician already has a license to practice medicine. I will investigate this more.

    I was also reading that physician assistants are licensed to prescribe in all 50 states. So in theory can't a pa prescribe the meds just as easily if not easier then the physician?
