    Exclamation Burglary Under 300 Dollars

    I am an 18 year old male with a completely clean record and I reside in Illinois.

    Last night I was out with a friend and he wanted to go look for unlocked cars to steal from. He found a spot in the back of a subdivision to park in. I knew the intentions for the night, so I dressed in all black, as did my friend. However, me being very cautious and anxious could not go through with anything, so I waited in my friends truck the entire time while he went around to find cars. I called him several times to pressure him to leave, but had no avail. I called him after about 40 mins and he sounded nervous and said he had to go. Minutes later I get a flashlight shined in my eyes and am told to get out ot the truck... I was handcuffed. All I had on me was my wallet, keys, phone, key chain flashlight and a small pocket knife. I informed the officer of the knife before he patted me down. There was no stolen items in the truck and no stolen items on me, making it impossible for me to have any involvement. There was 60g of marijuana and several peices of paraphanelia in the truck. The stuff was my friend's and he took full responsibility for it. Everything that was stolen was in possesion of my friend. There were also bolt cutters in my friends truck bed, which was counted as burglary tools.

    On the way to the station I wasn't really nervous about what was going to happen and held a conversation with the cop the entire ride about pepper spray and tasers. Also, we both joked around more than I think someone in this situation would. (I'm thinking my calmness and all will help to get the officer to believe that I didn't participate.)

    At the station: I was finger printed and asked if I would answer questions. I said I'm not doing this out of disrespect, but I would rather wait for a lawer. The entire time the officers interacted with me I was polite and respectful. Anyway, I was charged with burglary under $300, a misdemeanor. The officer said that I was arrested under probable cause only. There is no evidence against me. I had enough cash on me to post my own bail and got out. However, my friend was charged with 3-4 felonies and was sent to County(Will).

    What I want to know is what whill happen to me since this is my first offense ever. I'm thinking that since with logic I can prove that it was impossible for me to have involvement and since there is no evidence on me that the charges will be dropped. Does this sound like it can happen?

    Also, any idea on what will happen to my buddy? (I'm pretty sure the only offense he has is a DUI. He is also 18)

    Both of you will probably get probation, but your sentence will be a lot shorter.

    I finally found the penalty for theift under $300. It is up to a $2500 fine and/or up to a year in jail. What are the chances of me getting just a fine? Most importantly, I just want to know if there is a chance I will go to jail.

    Jail? Almost zero. It is possible you COULD get jail time, but this being your first offense I suspect you'll get probation/fines. It wouldn't surprise me if your friend also gets probation.
