    Angry Guest Turns Into Nightmare

    My husband and I agreed to allow another couple to stay with us, in our Texas home, for a short period of time (they were only suppose to be staying with us till that weekend). Never did we think it would turn into the 3 weeks from hell. My husband is serving in the United States Army and is currently deployed with this certain woman's husband. Before my husband left there were certain rules established including: absolutely no one at the house, that she could not walk in the house after 2 am, and absolutely no smoking in the house. He also made it quite clear that if any of these rules were broken, she would have to leave immediately. I went to spend time with my family for about a week, and I came back to a destroyed home. The person had thrown a party in my home and destroyed it, along with many of my belonging: there were cigarettes put out in my new title floors, bleach stains and burn holes in brand new carpet, broken beer bottles everywhere, piles of garbage everywhere and all of my belongings that were left at the house where either missing or had been rummaged through in my bedroom (including my filing cabinet). Not to mention I had locked my bedroom door before leaving. I do have pictures of my destroyed home. I asked the woman to leave considering that she had broken all of prearranged guidelines for her staying here, while our husbands were gone. She has never paid rent to us (considering we own the house), or helped with any of the utility bills.
    At first she refused to leave my house. Finally, she did end up leaving and took all of her belongings for the house, while I was not home. After she had left, I noticed that A LOT of my belongings are missing including military credit cards. A few days later she started threatening to come after me, as well as destroy my marriage with lies. She also wrote slanderous bulletins on the internet using my full name, and will not stop sending vulgar text messages and harassing phone calls. And if this wasn't bad enough, she also vandalized my husband's truck. I went to the police and they told me that I had basically no rights, and that I had to let her live here for 30 days because this was her legal residence. How is that possible considering she had never paid any money - and therefore was not a tenant, so tenant/landlord laws do not apply?? What can I do??

    The police say a lot of things - what they say is not always correct. How is that an issue, though, if she moved out?

    If you wish to recover for damages she caused, your best bet is with your homeowner's policy. I doubt that this person has much (if any) money to collect, even if you get a judgment. If you want to recover money from her, you need to sue her.

    is there anything i can do about the threats or slander? I have once again tried going to the police and yet they can still do nothing. I feel like my hands are tied. I feel like they dont want to take my case because i am young or it may be the fact that I am a military wife but i should get justice.. right? I was told by a friend to take her to small claims court for the slander and bad judgment towards my name. All i want is her to longer be able to harass me.

    She was a guest- you allowed her to stay. And you allowed her to remain in your home while you were gone for a week.

    Before you left, did you ask that she find another place? That might have been the time to ask the police to remove a trespasser.

    She doesn't owe you rent or utilities. If you want to recover money for damage to your property or for theft, take her to small claims court.

    If she attempts to harm you or harass you, inform her that everything is being recorded. You have no case against her for something you cannot prove.

    She was suppose to be staying in Austin for the time that I was gone. We do have proof of the damages, as well as all of the emails, text messages and the bulletin that was posted.
