    Default Problem with Downstairs Tenant

    Last year a "nice" older couple moved into the downstairs appartment. Right off I could see that this was going to be a problem. I could tell when I had to call the police 3 times in 1 week over partying from 12 a.m. to 6 a.m. Now almost a year later and many many count less parties...brawling and anything else they feel like doing the same stuffs still going on. The landlord kicked the guy out becasue he wasnt on the lease but when he is told the WOMAN is also the problem he goes to talk to her but he can watch her break into tears and tell some sob story. Just like now its almost 1 a.m. and I am awake because shes cleaning.. WHAT CAN BE DONE! Its getting to the point where I am going to have to go to a hotel to sleep!

    If your landlord refuses to act, and the police can't convince her to observe the local noise ordinance, your options become limited. You may be able to contend that the noise violations violate any implied or express "quiet enjoyment" provisions of your lease, which might entitle you to a rent abatement (if you litigate). Unfortunately, though, the best solution in this type of situation is often to move.

    Default Sometimes Moving isnt an option

    Sometimes Moving isnt an option.. at the present time this is pretty much all we can aford. If we could afford to move we are moving a few states away. lol I did end up calling the police last night. 2 people were arrested and an illegal knife was found. I am just waiting for it all to start up tonight.
