    Default Renter's Car was Towed

    Let me go into the history for a second.

    Renter has not paid rent in 7 months.
    Renter had inoperable car sitting in driveway.
    City cited and summoned landlord (who is legal owner of property) to court.
    Landlord contacted Renter, informed renter that the car needed to be fixed or removed.
    One month later, on court date - Landlord was informed that the car was still there.
    Landlord was told that if the car was towed, it would be dismissed.
    Landlord attempted to contact Renter, was ignored, left messages for Renter.
    Landlord towed inoperable car and case was dismissed.

    Can the Renter in the situation legally sue?
    If so, is there a good chance that the Renter will recieve compensation?

    You failed to identify a state, and we have no way of knowing if the landlord complied with the state's towing laws.

    Why hasn't the landlord evicted this loser?

    The state is Mississippi.

    The landlord was getting out of the rental property business and the eviction laws in MS (or rather, getting them properly executed) has been a joke. This tenant was one of eight that basically refused to pay rent and the courts (though the landlord had proper documentation) did very little to evict the tenants or to secure a judgement against them.

    I don't see any clear authority for the towing in the Mississippi Code. Is the tenant threatening a lawsuit?

    Yes, which is why i'm curious.

    I couldn't find anything anywhere about it.
