In California:
I'm waiting for my red light to turn green, when a driver going the other way turns left in front of me, enters the intersection, and then stops because they are stuck behind other cars in front of them.
My light turns green, and I don't enter the intersection because the other driver is in front of me, blocking the intersection. I'm pretty sure they should not have entered the intersection, because they should have been able to see that they could not complete the left turn, and you should only enter an intersection when you know you can get through before the light turns red.
I wait, light green for me, and the traffic in front of me remains stuck. Not wanting to miss the entire light cycle, I enter the intersection with the expectation that the traffic jam was about to move, and am now stuck behind the first car, that is stuck trying to turn left. I was assuming they would eventually move, and then I would get to continue through the intersection with the green light, but such was not the case.
Unfortunately, my green light turned red while we were both still stuck in the intersection. The other car soon was able to complete their left turn and go through the intersection (now green for them, red for me), and now I'm in the intersection with the light turned red for me.
In hind site, I probably never should have entered the intersection, and should have skipped the entire light cycle. But who knows, maybe the same thing would happen again and I'd get no where?
But anyway, I am now stuck in the intersection with a red light for me. I figure the safest thing for me to do now is wait for a clear chance and then get out of the intersection, which I do, and everybody is safe, no accidents.
My wife, sitting next to me, says that if someone with the green light hit us while we were stopped, it would be my fault because I was in the intersection with the light red. Period, end of sentence.
I think it would be their fault for not stopping, even though the light was green for them and red for me, because traffic laws clearly say you can only go through a green light if the intersection is clear of other vehicals, which it was not because I was stuck in it. I wasn't moving, and anyone with the green light would clearly see me and should stop, not hitting me.
So, in the hypothetical case where someone with the green light hits me while I was stopped in the middle of the intersection and clearly visible to anyone approaching the intersection, whose fault would it be?
