    Default Second Degree Retail Fraud Charge

    i work as a manager @ a local drug store. This kid (20 years old) got caught by the police running out of the store w/ stolen merchandise. I didnt witness him conceal it or see him run out the door with anything, but the cops saw him running from the store & stopped him. He's being charged with 2nd degree retail fraud - why? The thing he stole was only $13 - ive read until MI law that 2nd degree is over $200. and actually today in court the case got ajourned for reason of discovery because i guess the lawyer was new to this case. here's my questions:

    why is it 2nd degree?
    will i get called back to court again?

    Do you know the penal code number? There could be more involved like did suspect use a tool. did he fight etc. Had he committed another crime right before this? If you can give the penal code he charged under we might be able to help more. Also as you state you saw very little so there could be factors you ar eunaware of. Last its doubtful you will be called as you saw very little

    From what you say, the most obvious explanation for the second degree retail fraud charge is that he has at least one prior retail fraud conviction.
