    Default Wrong Surname On A Speeding Ticket in North Carolina

    Just yesterday I was clocked traveling 80 mph in a 65 mph just a few miles from the NC/VA border while heading back to VA. Question is this; the officer writing the ticket put a completely different last name on the ticket than what is displayed on my VA license. All other relevant information was correct to include the rental car information. Is this sufficient in building a case to dismiss in NC? Additionally any helpful tips would be appreciated as I have not had a ticket in 15 years and would prefer not to have one now.

    Do you have any idea how the error occurred?

    If your driver's license number is correct on the ticket, your odds of a dismissal based on this error are significantly reduced.

    I agree I think your chances of having it dismissed are remote. I think it will come down to whether the officer can point to you and identify you as the person who was speeding on the date and time in question. You may always impeach the officer with respect to why he wrote the wrong name down. If the judge thinks based on all this there is a genuine question as to whether the officer can really remember whether you were the person who was speeding then you may obtain an acquittal--but normally that is unlikely.

    That was my thought. A second question....does North Carolina report information back to Virginia? What I have run across in research does not make it clear as i have found different information. From my interpretation of the article below: It states NC will send information to another state if the speed is in excess of 15 miles per hour. So for my ticket of 80 in a 65 NC will not send that information back to Virginia. Correct?


    North Carolina Records—out of state violations are collected on
    N.C. licensed drivers (and N.C. violations are reported to states of drivers with out of
    state licenses) for the following violations: offenses involving exceeding the posted
    speed limit of 55 miles per hour or more by more than 15 miles per hour, driving while
    license suspended or revoked, careless and reckless driving, engaging in prearranged
    speed competitions, engaging willfully in speed competitions, hit and run driving
    resulting in damage to property, unlawfully passing a stopped school bus, illegal
    transportation of alcoholic beverages, and for any of the 15 violations found in NCGS §
    20—17. NCGS § 20—26(a)
