    Default Scam Marriages and Immigration

    Greetings!
    My problem seems to involve three areas of law: Family (CA), Immigration and International. Here my problem:

    Married a Ukrainian woman in Ukraine 04/04. She moved here 08/04 under a CR Visa. She moved out 03/05 to her sister's. We have been separated ever since. She filed for divorce 06/05 and is seeking spousal support and half of a$$et$ acquired during marriage.

    I filed for annulment in Ukraine based on bad faith marriage. I am told that I will get a favorable judgement.

    I believe that her intentions all along were to get into USA to be with her sister. There were several pre-marital representations made by her, which, in my opinion, make this much more than a case of "irreconcilable differences". Subsequent comments by her (threats of using false abuse allegations, stating that she did not want to live with me etc) were witnessed by others willing to testify.

    Questions: 1) Since California recognized the Ukrainian marriage, why would it not recognize the divorce? 2) Her Immigration status is up for review in a year; do I have any chance of causing the denial of her lawful residency in the USA? 3) Will USCIS wait until the 2-year interview before doing anything with the case? Thanks in advance.

    First, you state you petitioned for an annulment, not a divorce. Beyond that, there are issues of public policy and residency - your wife apparently is a resident of California now, not the Ukraine, and thus she can object to an effort to annul her marriage in her former place of residence.

    Any statement you give would certainly be considered. If the USCIS accepts your account, they would certainly have cause to question whether she should be granted residency.

    At present, they probably don't have any information which would lead them to take sooner action.
