my daughter, 16, was stopped for shoplifting at a Kohl's in Texas.
She had $52.00 in clothing in her purse. She was still in the store when approached by security.
She was kept in a back room, told to sign some papers, which she did. The store then called the police, who led her out of the store in handcuffs. At the police station she was told to sign more papers, and again she did. She can't remember what the papers said, she was upset and crying the whole time.
I was called after she had signed all papers and she had been booked. I was pretty upset myself and I didn't get a copy of the arrest record.
My question is, do I have a right to a copy of the papers she signed? Were her rights violated when she was told to sign these papers with no parent present?
The police officer told me he had no choice and had to refer the case to the DA, but probably nothing will happen because they have "bigger fish to fry". Does this sound correct?
