I am currently married to the father of the boys, the only bad thing is that when I delivered the boys, I was still married to my previous husband and after pulling their birth records we have discovered that his name is on the birth certificates. There has been a paternity test to prove that he is not the father of the children. Again, let me state that the man that I am currently married to is the biological father. In a situation like yours, you can do a name change, however, your husband will not be the legal father.

There are 2 ways to make your husband the legal father, you can terminate the legal father's rights and your husband can adopt. Or, you can file to disestablish paternity of the legal father and file to establish legal paternity of the bio father. Both choices will be costly because that is complicated enough that you really need to hire an attorney for it.
