Actions taken directly by the employer are fine. I was also concerned @ Il. has some protection re arrests/convictions but since OP didn't give any details, we can't comment on that.
Il. - employers may not inquire into or use the fact of an arrest as a basis for refusing to hire. (when there has been no conviction) Employers may inquire into & use the fact of a conviction as a basis for refusing to hire. But under the Criminal ID Act, employers may not inquire into or use the fact of a criminal hx record that has been expunged, sealed, or impounded, & employers must include on applications language stating applicants aren't obligated to disclose expunged or sealed records of arrests & convictions. Those requirements of the Criminal ID Act, however, don't apply to state police, Dept. of Corrections, prosecutors' offices, other law enforcement agencies, etc.
