I live in Vermont and just moved out of my apartment to take a job at a school. I moved into the apartment in June of 2007 and just moved out 2 weeks ago. I have someone who I found online who is not on the lease living in the apartment (subletting). The day I told her I was moving out. she said she was also moving out. I told her she needed to find someone to take her space (common courtesy), I had found my replacement, and actually about two weeks later found someone to take her room (I'm staying on the lease with the Landlord), and she came back and said she needed more time to find a place because she doesn't have time to look for a new apt. We spoke yesterday and I told her that she needed to be out by Sept 1st and she refuses to move out. Leaving me in an awkward position because I have two people moving in sept 1st. What are my rights for telling her she needs to leave?
She keeps on telling me that she takes orders from the Landlord not me, even though she’s not on the lease. And the landlord has made it clear to me that she doesn't, she is my tenant of sort and has no legal obligation with the landlord only me. I even asked her if she had legal rights to the apartment and she said no. And then I told her she needed to sign a subleases contract and she refuses.
I want her out! What are my rights?![]()
