    Default Hardship Waiver

Hello, my husband is in the process of deportation now. I am disabled and we have two small children, ages 7 and 2. He is in the process of being deported only because he is illegal, he didn't commit any crimes or break any laws here. He came here illegally because he had to sneak into the U.S. to become a refugee and claim asylum from Bangladesh which had a very corrupt government at the time, in the 90s. He did come here illegally but he did it to escape his government's persecution. They were falsely accusing him and others in his political party of committing crimes just because they were rallying or protesting against the government, non-violently. When he went into hiding they tried to find him by harrassing his parents and they burned down his house. He was in danger and that's why there was such an urgency for him to leave his country so quickly, he didn't have time to apply for his own visa so he used his cousin's, so that's why he came illegally. I don't have all the details, but I do know from what I'm told that all the charges against him and his party members were dropped and they were cleared of any wrong doing because they found out the charges were false when a new government was established in Bangladesh. Please understand, he isn't a terrorist, he's a devoted Christian and a decent, hard working man who just wants to be with us.

Please tell me if he has a good chance of getting a waver because of my disability and the hardship it causes for us, and also how long does this process usually take? 2 years? Thank you.

    -M.

Doesn't he have a lawyer assisting him with the deportation? He should be asking his lawyer these questions.
