    Default Probation Violation After Change Of Appointment Time

    coop was charged with rape in the 3rd (consentual sex with a 15 yr. old, he was 18), served 28 days in jefferson county, and was released on 10 yrs probation w/10 weeks of mental health counseling in oct. of 2005. in june of 2006 they violated him for moving out of my house, which he did not do, but was planning on doing upon agreement with his p.o. The people they said he was staying with made written statements that coop was NOT living there so they instead violated him for moving to the place he was planning on moving to even though he hadnt physically moved there yet. he turned himself in at the end of june and instead of remaining in jail and taking his case to trial, he plead out and was released in oct. 2006. In may of 2007, coops p.o. called me at 915 a.m. and asked where he was. i told her he was working. she told me there was a change to his regular appt. and she was violating him for missing his new appt. and that he was supposed to have been there at 9 a.m..she also informed me that she had sent him a letter to notify him of the appt. but that it had been returned to her and it was in front of her on her desk. He had no idea of the appt. No one did. We never recieved the letter and she knew it. he has been in jail since May 15th and still has yet to see a judge. What is going on?

    Why was the letter returned to her? If it is because she sent it to your house and it was returned with the stamp, "Forwarding Address Expired", she has probably inferred that he again moved without permission. (As he pleaded guilty to moving without permission on the prior occasion, whatever the circumstances, the probation department will deem him as having previously done exactly that.)

    i'm not sure exactly why it was returned to her...but all his other mail has been recieved here with no problems. papers from the d.a., the public defender, and the college he has applied to have all made it here. He was released to this address in october of last year, so surely she didnt send it to the other address (Canastota) and have it returned to her, and if that is what she did, is that appropriate? Would she do that just to be sure he hadnt moved again? And why wouldnt she call knowing he never recieved the letter?

    His lawyer can help him try to determine why the letter was returned.

    his lawyer right now is the public defender.....i dont know how these people get lawyer jobs, but this guy seems worthless and unwilling to hear anything we try to tell him....i'm not sure i can afford a criminal defense lawyer for him, and i'm really not sure that we have a case. i feel we do, but that doesnt mean a lawyer would. any suggestions on a lawyer in my area that might be interested in listening to me for less than 1500 dollars? what you guys are doing here is outstanding.....just talking to ANYONE who has even the tiniest glimpse of hope for coop at this point is a huge relief but i need to arm myself with some serious knowledge before i make an ass of myself....and coop
