    Default Disagreement About School Enrollment

    Maryland
    ok so dad and I split oh 3yrs ago I being the nice guy want my son to have a relationship with his father even thou I think he is an ass it's his father and he will eventually make his own decision about him. So anyway it's time for him to start pre-k it is stated in the order that parents are to discuss and agree on where child will attend. Father has not shown interest in childs welfare of being registed for school since I spoke with him about it in January. So I registered him for the best interest of my son. I don't want him to miss the opportunity of getting into school. Father in january stated he wants him to attend another school just because it's in his district I said no he said he will talk to his attorney I say go for it. But father has twiddled his thumbs for 8months and now there is a deadline for registering him but like I said as a concerned parent I registered him already due to the fact that for 8months dad has done nothing and deadline was approaching.

    So what does everyone think that the judge might say? If I go to court.

    You should have gone to mediation in January when you found out Dad didn't agree with you.
    I doubt anyone here could tell you what the Judge will decide.

    I would have done mediation but if you knew his father mediation wouldn't matter. He wants it his way and his way only would not matter if a neutral person was envolved. Therefore he will only do what a judge tells him to do. His father is the type that bashes women for being women. He feels that no matter what a judge says for say child support he feels he should not have to pay just because he says so. Thanks for your input.

    The father said "I'll talk to a lawyer" eight months ago? Has the father started any sort of court proceeding, or had his lawyer contact you? If he doesn't start court proceedings, in a matter of weeks the child will be starting school. Even if he files, enrollment deadlines aside, that's probably before a judge would be available to hear his petition.

    As Baystategirl indicates, you could have taken steps to resolve this earlier, but so could the father - that's a two-way street.

    Well recently received request to meet with arbitrator to resolve issue, but in maryland arbitration is not legal for family law cases only mediation.

    A request from your ex- or your ex's lawyer? Or an order from the court?
