    Default No Reaffirmation Agreement Filed for Mortgage in Michigan - What Can Happen?

    I filed for bankruptcy in Michigan and it was discharged almost exactly 2 years ago at this time (Aug. 2005). I signed reaffirmation agreements for my car loan and my mortgage at that time. Some time later, I noticed my mortgage statements were still saying "this statement is being sent for informational purposes only." I ran my credit report and noticed that they were also reporting the mortgage loan as being discharged under Chapter 7. I then contacted a represntative from my lender and they told me that the court where my bankruptcy was held apparently never filed the reaffirmation agreement for my mortgage.

    I have been making mortgage payments on time for the past 2 years, and am considering simply stopping and just walking away from the house and the payments (it's a long story about why I would consider doing this - basically I'm working 2 jobs to keep my house and am tired of doing this). What would happen if I did? Am I still obligated to repay if it's technically been discharged? What action could the lender take against me, and how soon would I have to be out of my house if I stop paying?
