I have been on LOA for 90 days due to a disability issue. My employer has already filled my position and moved on without me, which is fine because I have both Short-Term and Long-Term disability benefits through a 3rd Party provider. However, my employer is requiring a "release" from my doctor in order to terminate my employement, which doesn't make sense to me, since they don't have to guarantee my position and they have in fact already filled my position with another person. What rights do thay have to ask for a release from my doctor for me to be terminated so I can get my remaining vacation/sick leave and 401k released? My doctor does not believe they have to provide this because my employer has already filled my position, so I am stuck between the two sides. What rights do I have to ask for them to release me from my LOA under Federal or State Law?
