    Default Moved to Illinois While On Probation in Texas

    Hi, I was arrested for theft by property in Williamson County Texas, I stole $57 worth of merchandise and was arrestted, I plead guilty, and placed on 12 months defered ajudication probation. I was issued fines, community service (online) and a theft class. I recently moved to another state, and violated my probation, because I could not goto my next appointment - obviously. I am now wondering what my next step is? I know i need to get a criminal defense attorney. I am wondering what happens now if I happen to get pulled over? I do have other warrants other than my soon-to-be probation violation warrant, I also have warrants in Travis and Williamson county, just moving violations (unpaid tickets).

    My case is a class B Misdemeanor. I skipped my last appointment, have no paid my fines in a few months now.

    I am willing to work out this situation, I just cannot go back to TX now, I have a job, a place to live, etc...a.k.a. a life.

    I've heard so many people say - "if you're gone, then don't worry about it."

    I feel that there is some truth in that also, seeing as so many people live years after blowing thier probation off.

    I doubt you would be extradited over the Texas warrant, although I can't guarantee that. Your fugitive status may affect your eligibility for government benefits or college financial aid.

    i do want to take care of this situation, what would happen if i would try to get a il drivers license? or what would happen if i were to get pulled over? i have traffic ticket warrants and probation violation warrant.

    should i obtain a texas attorney, or illinois to help me out.

    The warrant is out of Texas, so I suggest consulting a lawyer in the county where the warrant was issued.

    I doubt that Texas will try to extradite you over that charge.

    I am a bit curious still. I have been reading more and more about POV's and others moving out of state and not paying thier fines, contacting their PO, etc. If I was placed on Deffered Adjucation (sp?) Probation, then I violated, I have two questions.

    Could I recieve an IL license? Would I be arrested on the spot?
    What if I wanted to return to the state of TX?

    ...just curious...

    If you are pulled over in Illinois you will be arrested. Illinois will call the police department in Texas that you are on probation with and notify them. They will then keep you in jail for 72 hours waiting for Texas to drive to Illinois to pick you up. This is unlikely to actually happen. Then you will be released. Your warrant will not be cleared, but you will be released.

    If you are arrested and put in jail for an alleged crime while you are in Illinois, they will also call Texas and tell them they have you. Texas will again be called and not wish to drive 300 miles for someone who was arrested for $57. They will have done this when you were arrested so you will not be kept any longer. However, if you were arrested without trial, go to your court date, and are then said to be released, they will keep you in jail up to 72 hours longer waiting for Texas to not come.
