    Question Changing My Daughter's Last Name, in Georgia

    I would like to change my daughter's last name to my husband's last name. I don't know where my ex-husband is and I am almost positive that he will not consent to it. I do know that he is in the Baltimore area. I have the forms for name change in Georgia and it states something about I don't need his persmission if he has abandoned the child or paid no child support which he hasn't in six years. I am trying to find out if this is something I have to prove first before filing the papers. I can't afford to hire a lawyer to this at this time, but the paperwork doesn't tell you what to do in this situation and I just moved to Georgia recently.

    I am trying to find out if this is something I have to prove first before filing the papers.

    It is something you prove after you have filed your lawsuit.
