We are in a property dispute with our neighbor. (Texas is our state) Our house was refinanced in 2006 and a survey was done. The survey shows our neighbor's fence is 3 feet over on our property and we want it the 3 feet back. She disputed the survey results we got. She had a survey done and she had to have the entire block surveyed and the results she got were within 2 to 3 inches of the results of our survey. She had agreed at one time to let us move the fence as long as we took care of it. She also has shrubs and sprinkler heads on our property line between our front yards. She agreed to move those as well as let us move the fence. When we decided to move the fence she then got billigerant and stated we would have to have a court order to move the fence, police were called out, etc. She has a temporary restraining order against us also. What I want to know is finding the statute of limitations because we did consult 3 different attorneys (all of whom we cannot afford their retainer fees) because one of the attorney's told us that we could try to get our 3 feet of property back under the 25 year statute of limitations because she has to have done 3 things under that statute one which is put up a fence-she did, second, cultivate the land-which she has done and three pay the taxes for that property. She has nver paid the taxes on our portion of the property. This was my childhood home that I grew up in and my mother paid the taxes until her death and we moved in and have been living there since before her death and have paid the taxes ever since. Can you help get me some information or let me know where I need to look to get that information.
