Just want to start out by thanking everyone that helps people on this forum. It's a great idea!
My finacee just found a new job but is currently employed at another. In her current job they had her sign a contract that says she needs to give 60 days notice before leaving. But the new job wants her to start sooner. My question is what happens if she just leaves without giving a 60 days notice? We are in Virginia.
Here is what the contract says for the termination portion:
"Section 3.06: Employer and Employee may terminate this Agreement at any time without cause and such termination shall be effective sixty (60) days after the Party so terminating the employment has given the other written notice of its election to terminate. Employee may also be considered for termination if the following occurs: A. Suspension, revocation, disqualifcation or limitation of practice license to practive in the state of virginia. B. Limitation, restriction, modifcation or termination of employees right to prescribe medication. C. Limitation, restriction, suspension, curtailment or termination of Employees staff privileges at any area hospital. D. Any act or omission by Employee which adversely affects the ability of employer to obtain payment or reimbursement for Employees services from any H.M.O., P.P.O., or similar provider to include Medicare and / or Medicaid."
The last section says " Section 5.01: This agreement shall be governed by and construed in accordance with the laws of the State of Virginia."
Does anyone have an idea of what would happen if she just up and left one day? If not, can someone please direct me in the right direction to find out what would happen?
