here we go again. my husband had his first vop last year with a dirty urine. spent 2 months in county & sentenced to 6 mths house arrest w/ an ankle bracelet. 3 months in, he forgot to put his tracking box & charger in the bedroom & it lost signal during the night. got violated again, spent 3 months in jail for that one & released back on regular probation with gps monitoring. (standard for all registered sex offenders who violate probation after July 2006) Last month, he had a dead battery on his tracking device & is now back in jail for "not following the rules of the electronic monitoring program by failing to fully charge his unit". The charger stand had been acting up for some time & he had let his P.O. know about it. She was out for awhile & the on call officer was the one who sent the violation report. We are currently waiting on a report from the monitoring co. to show there was a problem with the charger. Do you think theres any chance of getting his probation early terminated or is this probably one too many technical violations? (he's served 9yrs of a 15yr probation sentence) Also, isn't the gps requirement illegal because it wasn't a term of his original felony probation?![]()
