    Default Never Signed New Lease With New Landlord

    State of Vermont - I moved into an apartment and signed a year lease in March 2005. After the year was up, the landlord agreed to go month-to-month. Then, last year, he sold the building. The new landlord gave me a new lease (with a one year term) to sign effective October 2006. I never signed or returned the lease to him because I knew I wanted to buy a house and did not want to be bound by a lease when I found one. So...I just bought the house last week and sent the landlord a 30 day 'intent to vacate' notice (via certified mail so I know he received it). I paid full rent for the month of August even though I am moving out this weekend. My question is about the return of my security deposit---will I get it back? Also, is there a valid lease even though I never signed it?

    if you did not sign the lease, then there is no lease other that the original one that converted to a month to month tenancy. So yes, there is a lease.

    as long as you abide by the rules rerquired in that lease and by state laws, your deposit should not be forfeit based on anything such as this.

    (d) Unless inconsistent with a written rental agreement or otherwise provided by law, a tenant may terminate a tenancy by actual notice given to the landlord at least one rental payment period prior to the termination date specified in the notice.
    As I read that

    statute, you would have had to give notice prior to Aug 1 (if your rent is due on the first of the month) to be able to vacate by the end of Aug without further obligation. If you gave notice after Aug 1, you would be obligated until the end of September.

    You were not very clear as to when the LL recieved notice.
