Ok, this might get a little long and I apologize. I will try to stick to the main points.
I am currently going through a civil suit over credit card debt belonging to my former boyfriend. He claims that he did not know about any of the credit cards and yet he was the one to get the mail daily, mow the yard with that charged lawn mower, provided all the answers that were asked when applying for the cards, and benefitted from everything that was charged.
About 4 months before I was told to leave, I learned that I was coming into a sizable inheritance and that is what the plaintiff is sueing me for, as well as, my property. The property part is kinda funny because the plaintiff actually has everything that I do own except for a few clothes and my car that I was allowed to leave with. My car is 15 years old and nothing to brag about and the plaintiff did damage the motor, so it is not exactly a reliable source of transportation.
The plaintiff did file identity theft charges against me with his local sheriff department and after I went in and spoke with them, (I even agreed to a lie detector test), nothing more came of that after I showed them a letter from one of the credit card companies showing that they found the plaintiff to be responsible for all the charges because he did benefit from them. The plaintiff did tell me that he was going to do this and I tried to contact all of the credit cards with my side of the story and actually provided them with the details for the majority of purchases. At that point in time, I honestly thought it was over.
About 3 months later, I received the paperwork for the civil suit against me, my inheritance, and my property. I am currently living with my parents and my mother signed for the letter. The first thing that I noticed was that my last name was spelled wrong. Engle was who they are sueing and my name is Engel. There are several Engle's in this area as well. Pointed that out to my attorney and he just blew it off like it was nothing. Pretty sad that you spend all that time with someone and they can't spell your name correctly.
I also received a couple of calls from credit card companies that were following through with the fraud claims and offering me deals to pay it off now or they would file fraud charges against me. I was like, excuse me but I am currently being sued for this so how can you try to collect this and file charges against me for it too? Left my attorney deal with them and have heard nothing more.
My inheritance check finally shows up after several months worth of delays and it has doubled because of all the delays. First thing I do is open a savings account and buy a reliable vehicle. The next thing, buy a mobile home to live in and all the little things that one needs to live. Dishes, towels, pot and pans, ect.. My parents should not have to continue to support me because I picked another loser to live with. I paid off my bills, sent some cash my parent's way for food, electricity, water, room and board. Then after I had it all spent, I get the next letter informing me that a prejudgment attachment was awarded against my inheritance and my property. If I do not comply with the demands, I will be found in contempt of court and go to jail.
Now, the plaintiff has done all this because he wanted my inheritance. He and his attorney knew about my inheritance long before they sent off the attachment paperwork. So why wasn't this done long before I received my inheritance? I would ask my attorney but he is in the hospital again. Open for ideas and input.
