    Unhappy Overpaid By Last Job, And They Want The Money Back

    Hi,

    At my previous job (which I was hired for a one year contract, and they knew up front the date I would finish) I had direct deposit set up. 2 weeks after my finish date I received one pay periods worth of money deposited into my checking account. I assumed it was because my first paycheck was 2 weeks after I stared working.

    Now, three months later - after the money is gone to car payments and rent - I get an email from the company stating that they made an accounting error and they want the money back. Currently, I don't have anywhere near that amount of money to give back in a lump sum like they want it.

    What are their legal rights, and mine in this situation? Thanks in advance for any help.

    If they overpaid you, they have the right to request the money back, and to sue you for it if you don't return it. You would have the "right" to return the money, as it isn't yours.

    You can contact them, explain your financial situaton and see if they are willing to arrange a pay back schedule that gives you some time to repay them. However, as aaron notes you owe them the overpayment. Their error doesn't mean that you get to keep the overpayment.

    I would do as mitousmom suggested - ask if you can pay the money back in installments. Since the money isn't yours (error or not), you have to pay it back.

    Thanks everyone for the replies. Yeah, I guess that is the issue. I always intended to pay it back - I just really need a payment plan and they are not being flexible with this at all.

    I guess I have no recourse if they demand a lump sum, even though it was their mistake in the first place.

    However, something tells me that if I ask for that money back from my credit card company because I mistakenly used money that wasn't my own to pay them, I would have a lot of difficulty getting it back....

    The difference is that you legitimately owed money to the credit card company. They don't have to repay you money that you legitimately owed to them because you found out the money you used wasn't yours.

    You do have to return money that you were not owed.

    If you paid the credit card company money that you did not owe them, they'd have to return it too.
